Welcome to Event Planner Matchmaker, by using this site you agree to the terms below. Note that we may refer to Event Planner Matchmaker LLC, as Event Planner Matchmaker, Event Planner Matchmaker services or eventplannermatchmaker.com in this document.
ACCEPTANCE OF TERMS. If you are 18 years old or older, we grant you a limited, revocable, nonexclusive, non-assignable access to Eventplannermatchmaker.com. You must comply with all federal, state and local laws and must have copy rights to any images or content you post on Eventplannermatchmaker.com. Your postings must be targeted to general public and must not be unlawful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or harmful in any way to minors. No “adult only” content allowed.
You agree not to use or provide software or services that interact or interoperate with Eventplannermatchmaker.com, e.g. for downloading, uploading, posting, flagging, emailing, search, or mobile use. Robots, spiders, scripts, scrapers, crawlers, etc. are prohibited, as are misleading, unsolicited and unlawful. Spam postings, messaging and emails are also prohibited at eventplannermatchmaker.com. You agree not to collect users' personal and/or contact information.
You are not allowed to post irrelevant content, not related to party and event services. Spam postings are prohibited and will not be approved to post on eventplannermatchmaker.com site, so don't waste your time trying to post irrelevant material.
Unless authorized by Event Planner Matchmaker, you agree not to distribute, make derivative works, display, sell, or "frame" content from eventplannermatchmaker.com , excluding content you create and sharing with friends/family.
By posting any content in www.eventplannermatchmaker.com, you grant us a perpetual, irrevocable, unlimited, access and permission to use, copy, perform, display, distribute, advertise by any mediums including social media, other internet platforms and sites, and make derivative works from content you post to eventplannermatchmaker.com. Furthermore, by subscribing and / or using our Event Planner Matchmaker platform you give us permission to subscribe you to our monthly newsletter and any other type of communication and give us permission to reach out to you by phone, email, social media or any other means possible to communicate with you if necessary.
MODIFICATION OF TERMS AND CONDITIONS. We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modification shall become effective immediately upon the posting thereof. You are responsible for reviewing this agreement on regular basis to keep yourself apprised of any changes. Event Planner Matchmaker has the right to at will email enrolled members about changes to these terms of use.
SERVICE. Event Planner Matchmaker provides the service of matching Party Throwers (Event Hosts) to Party or Event Planners, as well as to provide a database where party and event planners can store their profiles. You understand that Event Planner Matchmaker only provides the connection between Event Hosts and Event Planners and is not responsible for any of the event planners services or agreements between event planners and event hosts. Any dispute including payment, delivery of goods or services, and any terms, conditions, warranties or representations associated with such dealings or any other disagreement need to be resolved / settle directly between the two parties in disagreement without involving Event Planner Matchmaker. Event Planner Matchmaker is not in any way responsible for your dealing or agreements between parties connected through eventplannermatchmaker.com. You agree that Event Planner Matchmaker is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or usage of this platform. In the event that you have a dispute with one or more users or with third parties, you hereby release Event Planner Matchmaker, its officers, employers, employees, agents, contractors and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspects to exist in favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
TERMINATION OF SERVICE. You agree that Event Planner Matchmaker , in it's sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to access or use of our service, immediately and without notice, and remove and discard any content within our Service, for any reason, including without limitation if Event Planner Matchmaker believes that you have violated or acted inconsistent with our terms of use or if Event Planner Matchmaker was to go out of business. Further, you agree that Event Planner Matchmaker shall not be liable to your or any third-party for any termination of your access to the Service or deletion of any data.
UPTIME / DOWNTIME. Event Planner Matchmaker does not use it's own data servers. A hosting service is used for Eventplannermatchmaker.com. Uptime is dependent on the hosting service. We looked for a good hosting service but no hosting service can provide a 100% uptime. Servers are always prone to data failures, malfunctions, virus attacks, maintenance time down etc. Equally our website has the potential of running into glitches so you understand that we don't promise any uptime percentage, we expect to be up and running most of the time with occasional down times from server maintenance or failures or for website maintenance etc., same as most other reliable websites.
CONTENT. You understand that all postings, messages, text, files, images, photos, videos, sound or other material posted on, transmitted through, or linked from our service platform, are the sole responsibility of the person from whom such content originated. More specifically the person posting content is entirely responsible for content that they post, email or otherwise make available via our service platform. You understand that Event Planner Matchmaker does not control and is not required to monitor the posted content, so we are not responsible for content made available through our Event Planner Matchmaker Platform, and by using our platform services, even though it is not approved by Event Planner Matchmaker, you may be exposed to content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the Eventplannermatchmaker.com site and content may contain links to other websites, which are completely independent of Event Planner Matchmaker and we make no representation or warranty as to their content, accuracy, completeness, or authenticity of the information contained in any such site. Your linking to any other website is at your own risk, You agree that you must evaluate, and bear all risks associated with, the use of any content, that you may not rely on said content, and that under no circumstances will Event Planner Matchmaker be liable in any way for any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed or otherwise made available via the Event Planner Matchmaker service. You acknowledge that Event Planner Matchmaker only does occasional minimal pre-screening on content posted to Eventplannermatchmaker.com, but Event Planner Matchmaker shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any content that is available in Eventplannermatchmaker.com, for violating these terms of usage or by any other reasons.
CLAIMS OF INFRIGMENT / COPY RIGHT. If you believe that your work has been copied in any way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated somewhere in the Eventplannermatchmaker.com site. Please first contact the person (posting individual) whom has performed the copyright infringement. If you get no response and/or the issue is not resolved then feel free to contact us through the contact page in our Eventplannermatchmaker.com website. You will need to provide us the following info: 1) Identify the material on the Eventplannermatchmaker.com website that you claim is infringing, with enough detail so we can locate it. It should include the title of the posting and / or link to the page; 2) A written statement by you with your signature stating that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law and declaring under penalty of perjury that (a) the information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner; 3) Your address, telephone number, and email address;
SALES. We are offering free profile hosting services to Event Planners. Client connections are charged to Event Planners as per our “Pricing” page. We can provide any promotions as we see necessary. We also reserve the right to change the platform service offering as we see fit for a successful business. The service is completely free for party throwers and event hosts and we plan to keep it that way.
OTHER. If you don't agree to any of the terms in these document please discontinue use of this Eventplannermatchmaker.com website immediately.
DISCLAIMER OF WARRANTIES. MANY JURISDICTIONS HAVE LAWS PROTECTING CONSUMERS AND OTHER CONTRACT PARTIES, LIMITING THEIR ABILITY TO WAIVE CERTAIN RIGHTS AND RESPONSIBILITIES. WE RESPECT SUCH LAWS; NOTHING HEREIN SHALL WAIVE RIGHTS OR RESPONSIBILITIES THAT CANNOT BE WAIVED. YOU AGREE THAT USE OF THE EVENT PLANNER MATCHMAKER SITE AND IT’S SERVICES IS ENTIRELY AT YOUR OWN RISK. THE EVENT PLANNER MATCHMAKER SITE AND IT’S SERVICES ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. EVENT PLANNER MATCHMAKER DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE EVENT PLANNER MATCHMAKER SITE AND IT’S SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, EVENT PLANNER MATCHMAKER DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE EVENT PLANNER MATCHMAKER SITE OR ACCESSED THROUGH ANY LINKS ON THE EVENT PLANNER MATCHMAKER SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, EVENT PLANNER MATCHMAKER DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICES.
LIMITATIONS OF LIABILITY. UNDER NO CIRCUMSTANCES SHALL EVENT PLANNER MATCHMAKER BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF EVENT PLANNER MATCHMAKER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICES, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICES, FROM INABILITY TO USE THE EVENT PLANNER MATCHMAKER SITE OR IT”S SERVICES, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICES. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICES OR ANY LINKS ON THE EVENT PLANNER MATCHMAKER SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE EVENT PLANNER MATCHMAKER SITE OR IT’S SERVICE OR ANY LINKS ON THE EVENT PLANNER MATCHMAKER SITE.
